Terms of Service

1. Acceptance of Terms

By accessing or using ServiceProMagic.com ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

ServiceProMagic provides AI-powered website generation and hosting services for businesses. Our Service includes:

  • Automated website creation based on your existing web presence
  • Website hosting and maintenance
  • Change request system for website modifications
  • Lead capture and form handling
  • Appointment scheduling and appointment-related text messaging features
  • SEO optimization features

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

4. Business Authorization and Ownership Representation

By generating a website through our Service, you represent and warrant that:

  • You are the owner of the business for which the website is being created, or you are an authorized representative with the legal right to create and manage a web presence on that business's behalf.
  • You will not use the Service to create websites for businesses, individuals, or organizations for which you do not have authorization.
  • All business information you provide (name, address, phone number, services) is accurate and belongs to the business you represent.

ServiceProMagic reserves the right to immediately remove any website and terminate any account found to be in violation of this section, including websites created for businesses without proper authorization. Creating a website impersonating another business, individual, or organization may also constitute a violation of applicable laws and our policy.

4a. Site Inactivity and Auto-Deletion Policy

To maintain service quality and ensure our platform is used by active businesses, websites without an active subscription are subject to the following auto-deletion policy:

  • Day 0: Your site is created and a free preview period begins.
  • Day 45: You will receive an email warning that your site will be deleted in 15 days if no subscription is activated.
  • Day 52: You will receive a second email warning with 8 days remaining.
  • Day 60: If no subscription is active, your site content, hosted files, and subdomain will be deleted. Any connected custom domain will be unmapped (the domain itself will not be deleted from domain registrars, but it will no longer load your site).

Exception: If your account has ever had an active paid subscription, your site will be retained indefinitely regardless of current subscription status, as we want to make it easy for you to return.

You may reactivate a deleted site by subscribing and contacting support. However, site content from deleted sites cannot be guaranteed to be recoverable.

5. Subscription and Payment

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring basis ("Billing Cycle"). Billing cycles are set on a monthly, annual, or biennial basis, depending on the type of subscription plan you select.

At the end of each Billing Cycle, your Subscription will automatically renew under the same conditions unless you cancel it or ServiceProMagic cancels it.

5. Free Trial and Change Requests

ServiceProMagic may offer a free trial period and/or free change requests for new users. At the end of the free trial or upon exhaustion of free change requests, you will be required to subscribe to continue using certain features of the Service.

6. Content Ownership

You retain all rights to the content you provide to us for website generation (logos, images, text, etc.). By using our Service, you grant ServiceProMagic a license to use, modify, and display this content solely for the purpose of providing the Service.

The website templates, designs, and AI-generated code created by our Service are provided for your use as part of your subscription. You may not resell, redistribute, or sublicense the generated websites or their underlying code.

7. Acceptable Use

You agree not to use the Service to:

  • Create websites for illegal purposes or promoting illegal activities
  • Infringe upon intellectual property rights of others
  • Distribute malware, spam, or harmful content
  • Attempt to gain unauthorized access to our systems
  • Create websites impersonating other businesses or individuals
  • Violate any applicable laws or regulations

8. Text Messaging Terms

ServiceProMagic may provide appointment-related text messaging features for businesses and their customers. These messages may include booking confirmations, scheduling follow-ups, appointment reminders, and customer-care replies related to active service inquiries. ServiceProMagic text messages are intended for transactional and service-related communication, not third-party marketing or promotional messaging.

By providing your phone number and checking an optional SMS consent checkbox on a ServiceProMagic or ServiceProMagic-powered business website, you agree to receive appointment-related text messages from ServiceProMagic or from the business you contacted. Consent to receive text messages is not a condition of purchase.

  • Message frequency varies based on your appointment activity and service inquiry.
  • Message and data rates may apply.
  • Reply STOP to opt out of future messages.
  • Reply HELP for help.

9. Service Availability

We strive to maintain 99.9% uptime for hosted websites. However, we do not guarantee uninterrupted access to the Service. We reserve the right to suspend or discontinue the Service at any time for maintenance, updates, or other reasons.

10. Limitation of Liability

In no event shall ServiceProMagic, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

11. Refund Policy

We offer a 30-day money-back guarantee for all subscription plans. If you are not satisfied with our Service within the first 30 days of your subscription, contact us for a full refund. After 30 days, subscriptions are non-refundable.

12. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately.

13. Domain Registration Services

ServiceProMagic may offer domain name registration and management services as part of or in addition to the core Service. The following terms apply to any domain purchased through our platform:

  • Registrant Ownership. Domains purchased through ServiceProMagic are registered in your name using the contact information you provide. You are the legal registrant of record with the underlying registrar. ServiceProMagic acts as a reseller on your behalf and does not claim ownership of domains registered for your account.
  • Accurate Contact Information. You are responsible for providing and maintaining accurate registrant contact information (name, address, email). Inaccurate WHOIS data may result in domain suspension per ICANN policy. You agree to update your contact information promptly if it changes.
  • Renewals. Domain registrations are annual and will be automatically renewed using the payment method on file unless you cancel at least 7 days before the renewal date. You will receive renewal reminder notices at least 30 days in advance. ServiceProMagic is not liable for domain expiry resulting from outdated payment information or failure to respond to renewal notices.
  • Domain Transfers. You may request to transfer your domain to another registrar at any time by contacting support@servicepromagic.com. We will provide the EPP/authorization transfer code within 5 business days of a verified request. Transfer requests will not be unreasonably denied or delayed.
  • DNS Management. ServiceProMagic configures DNS records on your behalf to point your domain to your website. You may request DNS changes through your dashboard or by contacting support. We are not responsible for service interruptions caused by DNS changes you initiate.
  • Service Discontinuation. In the event ServiceProMagic ceases operations, we will make reasonable efforts to notify all domain registrants at least 60 days in advance and provide EPP transfer codes so you may move your domain to a registrar of your choice. Your domain registration will remain active through its current expiry date regardless of our operational status, as it is held with an ICANN-accredited registrar.
  • Prohibited Uses. Domains registered through our platform may not be used for spam, phishing, malware distribution, trademark infringement, or any activity prohibited by ICANN policy or applicable law. Violation may result in immediate domain suspension without refund.
  • Refunds. Domain registrations are generally non-refundable once the domain has been registered with the underlying registrar, as these costs are non-recoverable. Exceptions may be made at our sole discretion for verifiable registration errors.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

15. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
